Kimi K3, a large language model that Chinese AI lab Moonshot announced on July 16, has reignited a US debate over restricting Chinese AI models.

Axios reported on July 20 that debate over restricting advanced Chinese models has reignited within the Trump administration, and on July 21 Treasury Secretary Scott Bessent said the US would examine Chinese open-source models for signs of intellectual property theft, with sanctions possible if theft is established.<\/p>\n\n\n\n

What Is Kimi K3, the 2.8-Trillion-Parameter Model?<\/strong><\/p>\n\n\n\n

Kimi K3 is a 2.8-trillion-parameter AI model Moonshot announced on July 16. Open-weight means the trained parameters are made public; it does not necessarily mean the training code or data are released. Moonshot positions K3 as an open-weight model but says the full weights will be released by July 27 \u2014 as of July 21, the model is available through Kimi’s services and API.<\/p>\n\n\n\n

Reuters, citing Moonshot, described K3 as the world’s largest open-weight AI model, and reported that it is closing the performance gap with top US models. Kimi K3’s official API pricing is $3 per million input tokens (cache miss) and $15 per million output tokens.

On a simple comparison of published per-token rates, Kimi K3 is cheaper than Claude Fable 5 \u2014 Anthropic’s most capable widely released model \u2014 which costs $10 per million input tokens and $50 per million output tokens.

Running a 2.8-trillion-parameter model in-house, however, requires large-scale computing infrastructure. Even so, once the weights are available, companies and research institutions gain options \u2014 including running the model through third-party inference providers \u2014 that do not depend on any single closed lab’s API.<\/p>\n\n\n\n

Shelved Proposals Return After Kimi K3<\/strong><\/p>\n\n\n\n

According to Axios, the Commerce Department considered adding Chinese AI labs to the export-control Entity List in 2025. Security advisories from the NSA and others, and an executive order that would have required companies hosting Chinese models to guarantee security and accept liability, were also floated \u2014 but all were shelved at the time over concerns about stifling innovation.<\/p>\n\n\n\n

Kimi K3’s release has revived the debate. Axios reports that the measures now under discussion include government procurement rules, Entity List threats, and public pressure on companies using Chinese models \u2014 not necessarily an outright ban. Neither the White House nor the Commerce Department responded to Axios’ requests for comment. Meanwhile, Politico reporter Sophia Cai posted on X, citing sources, that Commerce is not currently moving to ban Chinese models.<\/p>\n\n\n\n

A new development came on July 21. Treasury Secretary Scott Bessent said on Fox Business that the US will examine Chinese open-source models for signs of intellectual property theft, and that sanctions are possible if theft is established. “This administration supports open source models, but what we do not support is IP theft,” he said, according to reports.<\/p>\n\n\n\n

The Case for and Against Restrictions<\/strong><\/p>\n\n\n\n

Supporters of restrictions point to possible data leakage to the Chinese government, embedded bias, and missing guardrails. TechCrunch notes, however, that many experts consider it unlikely that open-weight models running on US servers would leak data back to China.<\/p>\n\n\n\n

The outlet argues that the debate is not only about national security; it also involves business and competitive stakes around the profitability of closed-model providers. Indeed, Dean W. Ball, OpenAI’s head of strategic futures, argued in personal posts that government agencies could issue non-binding guidance to create regulatory risk around Chinese open-weight models, nudging companies in regulated industries away from adopting them. He later walked back parts of the argument \u2014 including the claim that a regulatory crackdown was the administration’s best strategy \u2014 after criticism from figures such as Yann LeCun and Martin Casado. Axios, citing an anonymous source, reports that leading AI labs or their allies bring proposals to restrict open-source models to the administration every few months.<\/p>\n\n\n\n

Opposition to restrictions is also growing. David Sacks, a venture capitalist who co-chairs the President’s Council of Advisors on Science and Technology (PCAST), argued that leading labs are trying to use the government to eliminate their open-source competition. “Restricting open models wouldn’t make AI safer,” Hugging Face CEO Clem Delangue told TechCrunch, arguing that curbs would hide risks, concentrate power in a few hands, and make it harder for researchers and public institutions to help make AI safer. In the same article, Sam Bresnick of Georgetown’s Center for Security and Emerging Technology said halting sales of Nvidia’s H200 chips to China would be a more effective lever than banning open models.<\/p>\n\n\n\n

The full weights are due by July 27, and how widely US companies adopt Kimi K3 after that is one of the key things to watch. Whether the scrutiny Bessent outlined takes concrete form and leads to actual sanctions, and whether Commerce moves on procurement rules or the Entity List, remain open questions.<\/p>\n\n\n\n
